1. INTRODUCTION

Welcome to hokdetroit.com, including any related House of Karma websites, forms, booking pages, and subdomains (collectively, the “Website”).

These Terms of Use (“Agreement”) are entered into by and between you and House of Karma Creative Agency LLC, a Michigan limited liability company doing business as House of Karma (“Company,” “we,” “us,” or “our”).

This Agreement governs your access to and use of the Website and any services, communications, or materials provided by House of Karma (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by this Agreement.

2. ACCEPTANCE OF THIS AGREEMENT

By using the Services, you confirm that you are at least 18 years of age and have the legal authority to enter into this Agreement.

If you do not agree to these Terms, you must discontinue use of the Services immediately.

We reserve the right to update or modify this Agreement at any time. Changes become effective upon posting. Continued use of the Services constitutes acceptance of the revised terms.

3. SERVICES

House of Karma provides professional creative and business services, which may include but are not limited to:

• Branding and brand identity development

• Website design and development

• CRM systems and business automation

• Digital marketing strategy and content services

• Creative consulting and design services

All services are custom and provided pursuant to a written proposal, scope of work, or agreement.

4. PAYMENTS, DEPOSITS & REFUNDS

• A non-refundable deposit of 25%–50% is required to begin any project

• Remaining balances are due according to the agreed project timeline

• All services are custom, time-based, and labor-driven

Refunds are not offered once work has begun. If a project is canceled after work has started, the deposit will be retained and completed work may be invoiced.

5. INTELLECTUAL PROPERTY

• Final deliverables become the client’s property once paid in full

• House of Karma retains the right to display completed work for portfolio, promotional, and marketing purposes unless requested otherwise in writing

• Unauthorized copying, reproduction, resale, or redistribution of materials is prohibited

6. USER RESPONSIBILITIES

You agree to use the Services lawfully and not to:

• Misuse the Website or communication systems

• Submit false or misleading information

• Send unauthorized or unsolicited messages

• Attempt unauthorized access to systems or data

• Upload malicious software or harmful content

• Infringe on intellectual property rights

We reserve the right to suspend or terminate access for violations.

7. SMS / TEXT MESSAGING TERMS

By voluntarily providing your phone number and completing an explicit opt-in process, you consent to receive SMS messages from House of Karma related to:

• Responding to your inquiry

• Appointments, scheduling, or service-related communication

• Project updates or customer support

• Optional promotions, service incentives, or networking event invitations only when you separately explicitly opt in

You may opt out at any time by replying STOP.

Consent to receive SMS messages is not a condition of purchase.

Carriers are not liable for delayed or undelivered messages.

8. SMS DATA PROTECTION

SMS opt-in data, consent records, and mobile information are not shared, sold, or distributed to third parties for marketing or promotional purposes.

Mobile information is used solely by House of Karma and shared only with service providers necessary to deliver messaging services (such as carriers and messaging platforms).

9. DISCLAIMER OF WARRANTIES

The Services are provided on an “as-is” and “as-available” basis. We do not guarantee uninterrupted service, error-free operation, or specific results from the use of our Services.

10. LIMITATION OF LIABILITY

To the fullest extent permitted by law, House of Karma Creative Agency LLC shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services. Your sole remedy is to discontinue use of the Services.

11. INDEMNIFICATION

You agree to indemnify and hold harmless House of Karma Creative Agency LLC, its owners, employees, and contractors from any claims, damages, or expenses arising from your misuse of the Services or violation of this Agreement.

12. GOVERNING LAW

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Michigan, without regard to conflict-of-law principles.

13. SEVERABILITY

If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

14. ENTIRE AGREEMENT

This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and House of Karma regarding use of the Services.
